FarmJoy (Trading Brand of FCL Distribution)

These Terms & Conditions govern the use of the FarmJoy Ltd website and the purchase of products sold under the FarmJoy brand. By accessing this website or placing an order, you agree to be bound by these Terms & Conditions.

1. Legal Entity & Trading Name

FarmJoy is a trading brand of FCL Distribution, a company legally registered in Jamaica.

All references to:

  • “FarmJoy”
  • “FarmJoy Ltd.”
  • “we”, “us”, or “our”

refer to FCL Distribution trading as FarmJoy.

All payments made on this website are lawfully received by FCL Distribution.

2. Eligibility to Purchase

By placing an order, you confirm that:

  • You are at least 18 years old, or
  • You have permission from a legal guardian to make the purchase

3. Products & Descriptions

FarmJoy offers food and beverage products including but not limited to:

  • Pepper & BBQ sauces
  • Marinades
  • Green juices
  • Wraps
  • Natural Juices
  • Powder Seasonings

We make every effort to ensure product descriptions, images, and prices are accurate.
However, minor variations in appearance, packaging, or labeling may occur.

4. Pricing & Payments

All prices are listed in United States Dollars (USD).

Where payment is processed or settled in Jamaican Dollars (JMD), the USD amount will be converted to its JMD equivalent based on the applicable exchange rate at the time of payment, as determined by FarmJoy or its payment processor.

Prices are subject to change without prior notice.

Payment must be made in full before orders are processed.

FarmJoy reserves the right to cancel or refuse any order where payment cannot be verified or where fraud is suspected.

5. Order Acceptance

An order is considered accepted only after confirmation via email, message, or invoice.

FarmJoy and FCL Distribution reserve the right to:

  • Cancel orders due to stock unavailability
  • Correct pricing or listing errors
  • Limit quantities per customer

Where payment has already been made and an order is cancelled, the customer will be refunded or credited accordingly, in line with Jamaican consumer protection laws.

6. Delivery & Shipping

Delivery is available within Jamaica.

Orders may be delivered using:

  • Third-party courier or ride-share services (including inDrive, Uber, Tara, Get It Sent), or
  • FarmJoy / FCL Distribution-owned delivery vehicles

Delivery fees and timeframes are communicated at checkout or order confirmation.

7. Risk & Responsibility

In accordance with fair trading practices:

  • Risk transfers to the customer once goods are delivered to the provided address
  • FarmJoy and FCL Distribution are not responsible for delays or losses caused by third-party couriers after dispatch

Customers are responsible for ensuring someone is available to receive the order.

8. Damage on Arrival & Consumer Rights

FarmJoy complies with Jamaica Consumer Affairs Commission (CAC) guidelines regarding defective or damaged goods.

If a product arrives damaged or defective, customers must:

  • Notify us within 24 hours of delivery
  • Provide clear photo or video evidence
  • Ensure the product is unused and in original packaging

Upon verification, FarmJoy will offer one of the following remedies, as appropriate:

  • Replacement of the item
  • Store credit
  • Refund (only where required by law)

This does not affect your statutory rights under Jamaican consumer protection legislation.

9. Perishable Goods Disclaimer

Due to the nature of food products:

  • Customers must properly store items immediately upon delivery
  • FarmJoy is not liable for spoilage caused by delayed acceptance, improper storage, or misuse

10. Returns & Refunds

For food safety reasons:

  • We do not accept returns on perishable food items unless they are damaged or defective at delivery
  • Refunds or replacements are handled in accordance with Section 8

11. Limitation of Liability

To the fullest extent permitted under Jamaican law:

  • FCL Distribution’s liability is limited to the value of the product purchased
  • We are not liable for indirect, incidental, or consequential losses

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

12. Third-Party Services

FarmJoy may rely on third-party services for:

  • Delivery
  • Payment processing
  • Communication

FCL Distribution is not responsible for failures or issues arising from third-party systems beyond our reasonable control.

13. Intellectual Property

All content on this website—including logos, images, text, and branding—is the property of FCL Distribution and may not be copied, reproduced, or used without written permission.

14. Prohibited Use

You agree not to:

  • Misuse the website
  • Attempt fraudulent transactions
  • Abuse replacement or refund policies
  • Violate any applicable Jamaican laws

FarmJoy reserves the right to suspend or refuse service where abuse is suspected.

15. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Jamaica.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.

16. Changes to These Terms

FarmJoy reserves the right to update these Terms & Conditions at any time.
Continued use of the website constitutes acceptance of any changes.
